These Terms and Conditions have been prepared by Teza OOD for governing the relations between Teza OOD, the owner of the web site https://onlinebulgarian.com/, hereinafter referred to as PROVIDER and USERS of the services provided by it, hereinafter referred to as the SERVICE.

Users are entitled to use the services at https://onlinebulgarian.com/ only for personal and non-commercial use.

USER is any individual or legal entity that is a party to a service agreement.

SERVICE/S on a site include/s:

  • Access to the web-based information resources/data provided on the web site
  • Creating of custom user profiles by registration at https://onlinebulgarian.com/;
  • Use of Bulgarian language online course for foreigners through registration
  • Live classes in real time with a teacher via web browser (Virtual classroom)
  • Use of a teacher in a place specified by the User or the premises of Teza.

The Terms and Conditions are an integral part of the service agreement. They will be effective from the date of their publication on the web site https://onlinebulgarian.com/ and will have effect to all users who use the service as of the date of entry into force of the Terms and Conditions.

Upon amendment of these Terms and Conditions, the Provider shall notify all Users of the Service in a dully manner.

Any amendment to these Terms and Conditions shall have effect for the User upon the explicit notification by the Provider and if the User does not state that they reject them within 14 days.

The user of the service agrees that emails exchanged between parties in the Terms and Conditions do not need to be signed with an electronic signature to have effect on them.
Users who use the Service without registration accept the changes to the Terms and Conditions from the time of use after their change without the need for being explicitly notified by the Provider.

2.1. Types of services

2.1.1 INTERACTIVE APPLICATION – The Interactive Application service is an online service and includes Bulgarian language online course for foreigners  “We discover the Bulgarian language”. The service is described in details at the web site https://onlinebulgarian.com/
2.1.2. ONLINE CLASSES concern providing the service Bulgarian language online course for foreigners, levels, A1, A2, B1, B2, C1, C2 via a real-time virtual classroom with a teacher.
2.1.3. CORPORATE TRAINING concern providing the service Bulgarian language online course for foreigners, levels, A1, A2, B1, B2, C1, C2 by attending classes with a teacher. The service is provided upon the User’s request for on-site training or Teza’s premises.

Activated services are valid for 90 (ninety) days deemed from the date of activation.

  1. PRICE OF THE SERVICE AND METHOD OF PAYMENT

3.1. The Provider provides the Service against remuneration due by the User in accordance with the service they have selected and the parameters of the service. Service Parameters are available to users at https://onlinebulgarian.com/.

3.2. Payment to the supplier is be made electronically via the web site https://onlinebulgarian.com/ or via bank transfer

3.3. The Provider confirms receipt of the payment by sending a notification email to the User of the Service or by another appropriate confirmation via electronic means.

  1. AGREEMENT FOR PROVIDING THE SERVICE TO THE USER. PROCESS OF NEGOTIATION

4.1. The Agreement between the Provider and the User constitutes these Terms and Conditions available at https://onlinebulgarian.com/, together with any amendments and supplements thereto.

4.1.1. The agreement is in English language.
4.1.2. A party to the agreement with the Provider is the User of the Service according to the data provided at the registration and contained in the personal profile of the User. For the avoidance of doubt, this is the information used for creating of an account with the Provider.
4.1.3. After getting familiar with the Terms and Conditions, the User shall make an online registration at the web site https://onlinebulgarian.com/, following the procedure announced in these Terms and Conditions.
4.1.4. By filling in their data and activating the “register” button, “accept” or other similar statement, the User declares that they are familiar with the Terms and Conditions, agrees with their content and undertakes to comply with them unconditionally.
4.1.5. When completing the registration process, the User shall provide correct and up-to-date data, as well as to update the registration data in the event of a change.
4.1.6. The registration process continues through the exchange of electronic communications between the Provider and the User where:
– The Provider confirms the registration made by the User by sending a letter to the e-mail address specified by the User.
– The User confirms the registration and conclusion of the agreement by following a link in the letter informing them on the registration.
– Upon confirmation, a user account is created and a contractual relationship is established between the User and the Provider.
4.1.7. The agreement is deemed for concluded when the User’s registration with the Supplier is completed.
4.1.8. In the event that the service is used without registration by the Users, the agreement for its use shall be deemed for concluded when the user uses it for the first time.

  1. RIGHTS AND OBLIGATIONS OF THE PARTIES

5.1. of the User:

5.1.1. The User is entitled to use the Service in good faith and only for its intended purpose,
5.1.2. The user undertakes not to use the Service in contravention of the law, good commercial practices, manners and customs
5.1.3. The User bears full financial responsibility for the correctness and completeness of the compulsory information provided to the Provider,
5.1.4. The user is required to: indicate specific needs or conditions regarding the use of the selected service of the serviced person, if any, at the moment of placing of the order (The supplier shall not bear responsibility for a problem if not notified in advance).
5.1.5. The user is obliged to pay the selected service in due time.

5.2. of the Supplier:

5.2.1. The Provider is required to take care of the professional and conscientious provision of the Service.
5.2.2. The Provider may temporarily limit, suspension of use or terminate the use of the Service:
– if it is established that a part or all of the information provided by the User is incorrect or false
– for breaches of obligations
– upon the request of bodies specified in a regulatory act
5.2.3. In all cases of limitation, suspension of use or termination of the service, the Provider shall notify the User of the reasons.
5.2.4. The Provider takes measures to protect the User Personal Data and the Serviced Person under the GDPR.
5.2.5. The Provider may require the User and the Serviced Person to identify and verify the accuracy of any circumstance and personal details announced during the registration process at any time.

  1. LIABILITIES

6.1. Liabilities for failure

6.1.1. For all cases of failure of their obligations under the Terms and Conditions, the parties are liable in accordance with the clauses of the agreement and the provisions of the Bulgarian legislation in force at the time of the failure.
6.1.2. The Provider shall not be responsible to the user for:
– lack of skills on the part of the Serviced Person to use the Service;
– third parties claims against the User in connection with and on the occasion of the use of the Service;
– the use of the Service for unlawful purposes or for performing unlawful actions by the Service;
– material damages and future earnings caused to the User or the Serviced Person as a result of the use of the Service, as well as in the event of a failure of the serviced person to use the Service;
– temporary or long-term inability for the Serviced Person to use the Service, related to technical violations or unsecured access beyond the Provider’s obligations;
6.1.3. The Provider shall not bear any responsibility for any damages caused to third parties in the use of the Service, or for the use of the Service for any unlawful purposes in any way or for the performance of unlawful actions via the Service;
6.1.4. In all cases of damages found, the Provider shall not be held liable if the damage is caused by force majeure, in extreme circumstances, and in order to protect persons and property or to prevent more damage.
6.1.5. The Provider shall not bear any responsibility for acts of the executing persons committed in connection with or on the occasion of the service selected by the User. In the event of any suspicion of a crime committed by the service provider or other unlawful action, the User may refer the matter to the competent authorities. The Provider shall provide full assistance in clarifying the circumstances and requesting information about Contractors as per the court procedure.
6.1.6 The Provider shall bear responsibility for causing material damage only and solely in the cases where the fault of the Contractor of the Service is proven by an enforceable court sentence.
6.1.7. Service performers are personally liable for damaged items.
6.1.8. The partners of the Provider managing online payments are not responsible for any damages caused by or in connection with the provision of the service.

  1. TERMINATION OF THE AGREEMENT

7.1. The Agreement for the provision of the Service shall be terminated:

7.1.1. Upon expiration of the term for which it was concluded;
7.1.2. By mutual consent of the parties
7.1.3. Unilaterally by a notice from either party in the event of default by the other party;
7.1.4. In the event of an objective impossibility of any of the parties to fulfil their obligations under the agreement;

  1. FINAL PROVISIONS

8.1. Any invalidity of any of the clauses of these Terms and Conditions shall not invalidate the entire agreement.

8.2. For any issues related to the execution and the interpretation of the individual clauses and the entire agreement the laws of the Republic of Bulgaria shall apply.

8.3. The parties shall make efforts to resolve disputes arisen between them regarding the application of the agreement through negotiations and mutual concessions, and if no agreement is reached, the disputes shall be resolved in front of the courts in the country or the Commission for Consumer Protection.

ORDER CANCELLATION POLICY

The user can terminate the service purchased through the Credit / Debit Card in the first 48 (forty-eight) hours by sending a message by email to admin@onlinebulgarian.com. In all other cases, the amount is not refundable.

Upon termination of the service as a result of the user’s fault, the user shall bear all fees for recovery of the amount.

If a refund is paid by a card, the amount will be refunded only on the card by which it was paid for.
